Diese paintings der Selbstbestimmung blieb Individuen zu Zeiten traditioneller Rechtssystemen für gewöhnlich verwährt, da in diesen Formen des Gemeinschaftswesens das Individuum der Gruppe vollständig untergeordnet conflict. An Stelle von Selbstbestimmung erlegte das damals vorherrschende Rechtssystem obligatorische Erbrechtsregeln auf, die den freien Willen des Verstorbenen bzw. seinen bevorzugt ausgewählten Erben in keinerlei Weise berücksichtigten. Dieses Verfahren zielte vor allem darauf ab, das Vermögen in einer vorhersehbaren paintings und Weise an die Gruppe des Verstorbenen weiterzugeben, um die finanzielle Absicherung von Nachkommen, Blutsverwandten, aber auch der Gemeinschaft zu gewährleisten und somit auch ihren Fortbestand zu sichern.
In dieser Hausarbeit sollen die Erbrechtsregeln in beiden Erscheinungsformen des islamischen Patronats näher erläutert werden, wobei aufgezeigt werden soll, wie ein ursprünglich nicht-Verwandter in den prestige eines Verwandten erhoben werden konnte. Dieses ermöglichte in gewissen, fest definierten Grenzen auch den Erwerb von Erbansprüchen, die denen eines echten Verwandten sehr nahe kamen, wodurch der Klient bzw. der Freigelassene zu einem gewissen Grad in Rivalität zu den „natürlichen“ Blutsverwandten trat. Zu diesem Zweck werde ich zunächst einen groben Überblick darüber geben, wie der Aufstieg des Islams die bestehende Erbrechtsstruktur veränderte, um anschließend die genaue Rechtsinstitution des islamischen Patronats mit seinen Zielen und Absichten zu erörtern.
